These Terms of Service govern your use of Upercart.com and any related services provided by Upercart Inc. By using the website or placing an order, you agree to these terms and our Privacy Policy.

1. Upercart services

Upercart currently supports two different shopping experiences:

• Jamaica local delivery: Upercart arranges local shopping and delivery to supported Jamaican communities.
• United States shipping: Products available in the United States market are packed and shipped to eligible US addresses.

Product availability, prices, delivery areas, shipping methods, and fulfilment times can differ by market and location.

2. Accounts and customer information

You must provide accurate and complete contact, billing, payment, recipient, and delivery information. You are responsible for keeping account credentials secure and for activity performed through your account.

When ordering for another person, you confirm that you are authorized to provide the recipient's contact and delivery information and that the recipient is aware of the delivery.

3. Products, prices, and availability

We try to keep product descriptions, images, prices, and availability accurate, but retailer inventory, packaging, sizes, weights, and prices can change. We may correct errors, update information, limit quantities, or remove unavailable products.

Some products are sold by weight. The final quantity or price may vary slightly based on the actual item purchased. Where an adjustment is required, Upercart will handle it through the order, substitution, credit, or refund process as appropriate.

4. Orders and payment

Submitting an order is an offer to purchase. An order is accepted after payment is authorized and Upercart confirms it can be fulfilled. We may decline, cancel, or adjust an order because of product availability, pricing errors, payment or fraud concerns, an unsupported delivery location, legal restrictions, or other operational reasons. When practical, we will contact you using the details supplied with the order.

You confirm that you are authorized to use the payment method provided and agree to pay the product total, delivery or shipping charges, taxes, and other amounts shown at checkout.

5. Jamaica local delivery

Jamaica local delivery is available only in supported communities. Delivery times are estimates and can be affected by order time, product availability, traffic, weather, recipient availability, and other circumstances.

If an item is unavailable, our shopper will normally contact you about a substitute or adjustment. If no substitute is accepted, the item may be removed or refunded as appropriate.

The customer is responsible for providing usable directions and a reachable recipient. For difficult-to-find locations, provide the community, landmark, phone number, and a map or shared-location link where possible.

6. United States shipping

Only products shown as available for the United States market are eligible for US shipping. Shipping methods, charges, and estimated transit times appear at checkout. Carrier delivery dates are estimates and may be affected by weather, service interruptions, address issues, or other events outside Upercart's control.

7. Cancellations, returns, and refunds

Contact us as soon as possible if you need to change or cancel an order. Once local shopping, packing, or shipment begins, changes may no longer be possible.

Returns, damaged items, missing items, substitutions, and refunds are handled under our Refunds, Returns & Order Issues Policy and our Cancellation & Order Changes Policy.

8. Acceptable use

You may not use Upercart for unlawful activity, fraud, abusive conduct, infringement of intellectual-property rights, unauthorized resale, interference with the website, automated scraping that disrupts service, or transmission of malicious code.

9. Third-party services

Upercart uses third-party providers, including Shopify, payment processors, retailers, shoppers, delivery providers, carriers, analytics providers, and marketing platforms. Their services may be subject to separate terms and privacy practices. Upercart is responsible for your order as described in these terms, but third-party outages and delays can affect service availability.

10. Privacy and communications

Our collection and use of personal information is described in our Privacy Policy. Transactional messages about an order may be sent even when you are not subscribed to marketing. Promotional communications are sent only as permitted, and you can unsubscribe using the link in an email.

11. Intellectual property

Upercart's name, branding, website content, original graphics, and other proprietary materials belong to Upercart Inc or its licensors. You may use the website for personal shopping but may not reproduce or commercially exploit protected content without permission.

12. Service availability and liability

We work to provide a secure and reliable service, but the website and services are provided subject to availability. To the fullest extent permitted by applicable law, Upercart is not responsible for indirect or consequential losses arising from use of the service. Nothing in these terms excludes or limits consumer rights or liabilities that cannot legally be excluded.

13. Changes to these terms

We may update these terms to reflect changes in our services, operations, or legal requirements. The current version will be posted on this page with its effective date.
